Borbonio-Olivio had two prescription drugs in his system, had no driver’s license, was speeding more than 10 miles over the speed limit, and was looking at money in his wallet at the time of the crash Saturday, according to arrest warrants obtained by The Herald.
Borbonio-Olivio tried to flee the crash scene before police arrived, prosecutors said.
“It is unfathomable how something like this could happen,” said Josh Byrdic, one of Charles Byrdic’s children. “The driver never should have been driving. He was distracted. He had no license. And now we find out he is here illegally.”
Byrdic, 60, was in his yard around 9:30 a.m. when Borbonio-Olivio ran off the road and hit Byrdic, said Randy Newman, 6th Circuit solicitor.
Byrdic died at the scene. He was hit so hard that he was knocked out of his shoes and catapulted from the suspect’s SUV, Byrdic’s family said.
Imagine having coffee on a weekend morning, watching your dad do whatever he's doing in the yard, and then having an SUV crush him right out of his shoes.
Build the damn wall already. And for Borbonio-Olivio? Death penalty. Sorry not sorry, but this repeat offender, this criminal, this murdering, border-hopping felon had a huge number of opportunities to NOT BREAK THE FUCKING LAW, and instead he continued his criminal ways and now an American is dead. Death Penalty.
UPDATE: Someone pointed out that he was arrested multiple times, but not deported.
I think that's actually worse.
Keep some perspective. This idiot wasn't turned over to ICE on any of his previous arrests because they were all driving infractions. If ICE had taken custody of him, he would have bonded out and disappeared. ICE concentrates on felons and gang members because ICE doesn't have enough money to deport every illegal alien in the United States (or to look for every absconder), so it prioritizes, the same way the police don't arrest every speeder they see, and prosecutors and Assistant U.S. Attorneys decline cases that don't meet their guidelines. It costs ICE around $100 to $200 a day to hold someone in custody, plus the cost of deportation itself, so they like to use that money to hold and deport felons. Until this crash, this alien didn't qualify.
ReplyDeleteAnd, death penalty? For a negligent homicide? Are you going to execute every multiple DUI offender when he finally kills someone? (Not a bad idea, but it won't get past the Eighth Amendment.)
Just to clarify: Your headline says "Frequently deported illegal alien . . .", but the story itself seems to say he was never turned over to ICE or deported, just that he was arrested several times for driving infractions.
ReplyDeleteFixed the title for ya. And yes, death penalty. This criminal shouldn't even be in the country. He has no license to drive. He was high on medication. And he tried to run away from the crash, which means he KNEW it was his fault.
ReplyDeleteAnd I'm firmly in support of moving anyone who kills someone through a DUI from a negligent homicide to murder. Ever had to help at the scene of a DUI? I have. It's not pretty. If you get drunk and plow into another vehicle and you kill someone, you should get the chair. Nobody forced that drink down your throat. Nobody forced you to drive drunk. Nobody out there caused you to plow into another vehicle. If you kill someone while you're driving drunk it's no different than if you pointed a gun at a crowd and pulled the trigger.
