Washington -- The Supreme Court on Friday bowed out of deciding whether the president has the power to imprison people in the U.S. indefinitely without a trial -- avoiding a showdown the Obama administration did not want.

The court granted the administration's request to dismiss the challenge to the president's authority from suspected Al Qaeda sleeper agent Ali Saleh Kahlah Marri, who was detained by the military for 5 1/2 years without charges.

But the court's order also vacates the federal appeals court ruling Marri was challenging, which had affirmed the president's power to detain people in the United States without trial.

Marri will be transferred to civilian custody as soon as next week to face charges of providing material support for terrorism. Obama administration lawyers had argued that the case before the high court was moot because Marri had been charged in the criminal system.

"We look forward to prosecuting this case in the criminal justice system and presenting the evidence for a jury to decide [Marri's] guilt or innocence," Justice Department spokesman Dean Boyd said.

The administration has been spared the unpalatable choice of defending the detention policies of the Bush administration, which candidate Barack Obama strongly criticized, or hurriedly renouncing a power that President Obama has never claimed.



Obama has ordered a review of detention policies, including the designation of suspects as enemy combatants who could be held outside the civilian justice system.

Obamas stimulust is saving jobs?

May I point out that the jobs that Acting President Obama is claiming his stumulus plan saved are jobs that would still be here anyway. I feel the need to further mention that every other report I have seen to date says that the jobs are still dropping like flies, including this article calling for Acting President Obama to do more.

While acknowledging an "astounding" number of job losses, President Obama told critics of his $787 billion economic recovery plan yesterday that it is saving jobs.

He suggested that critics who called the stimulus plan "unwise and unnecessary" should talk to 25 police recruits in Ohio's capital city who owe their jobs to stimulus spending. And "talk to the teachers who are still able to teach our children because we passed this plan," he said.

During a graduation ceremony for the police recruits, Obama also noted "the nurses who are still able to care for our sick and the firefighters and first responders who are still able to keep our communities safe."

Obama said the stimulus plan will save or create 3.5 million jobs in the next two years. But jobs numbers out yesterday showed that even if that happens, the economy won't be back to even.

The unemployment rate jumped to 8.1 percent last month, the highest since late 1983, with the loss of another 651,000 jobs. Three million Americans have been unemployed for at least six months. That means that since the recession began in December 2007, the economy has lost 4.4 million jobs.

US President Barack Obama has named Vivek Kundra as his chief information officer

Currently Mr Kundra works as head of technology for Washington DC - a role in which he championed Twitter, Facebook and YouTube as better ways for administrators to communicate with citizens.

In a statement about Mr Kundra's appointment President Obama said: "I have directed him to work to ensure that we are using the spirit of American innovation and the power of technology to improve performance and lower the cost of government operations."

When he starts his job, Mr Kundra will work alongside whoever is picked to act as a President Obama's chief technology officer. A decision on who will take on that role is expected soon.

Speaking after his appointment, Mr Kundra said he wanted to ensure the US has "the ability to run an open, transparent, participatory and collaborative government."

This guy got laid off only a few days after he put his family up for auction. They are willing to represent any "family oriented" product for the right price. In the comments he gets a lot of flac for not being willing to step out of that box. I think this is great.

A U.S. senator has suggested that voters have made Barack Obama eligible to occupy the Oval Office, whether or not he meets the constitutional mandate of being a "natural born" citizen.

The comments from Sen. Mel Martinez, R-Fla., came in an e-mail sent to a constituent shortly after the election, which just now was forwarded to WND.

The constituent had asked about Martinez's perspective on the issue on which WND and others have reported: claims made by dozens of lawsuits around the country that Obama might not meet the constitutional qualification for various reasons.

"Presidential candidates are vetted by voters at least twice – first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party's nomination after one of the most fiercely contested presidential primaries in American history," Martinez responded.


Though this Senator seems to be all over the board. In another article he compared Obama's tax plans to those in Castro's Cuba. Then he also states that Obama did not play the race card during the campaign. Though he did not vote for the Stimulus because he felt it would not do as desired.

It does look like this problem may resolve itself because:

California high court reviews gay marriage ban


Gay marriage opponents said overturning the California ban would change the nature of state government by gutting the people's right to make law.

The court would create "a sweeping power vested in the least-democratic branch that overrides the precious right of the people to determine how they will be governed," same-sex marriage opponents said.

Gay marriage proponents, led by former governor and current California Attorney General Jerry Brown, argue that the right to marry is part of the "inalienable right" to liberty, so the state Supreme Court must strike down even an amendment to the constitution limiting it.

Yep. Piss off. Bite me. Did anyone currently going "EEEEK! RUSH LIMBAUGH!" even bother to watch his speech at CPAC? Well, here's your chance. Part One. Part Two. Be advised, the total speech is about an hour and a half in length. And you know what? Rush Limbaugh articulated the Conservative viewpoint far better than anyone in the Republican Party has done in YEARS.

Oh, and all those "moderate" Republicans who still want to give advice and act like they know the Republican Party? Piss off.

Yep. Piss right the hell off, you spineless wankers. We did it your way, and we got John McCain, who spent more time stabbing conservatives than I care to count. Moderation in the defense of liberty is NO VIRTUE. The Republican leadership has spent so much time wanting to be liked, and wanting to be included in the right social circles in D.C., that they compromised on every. Single. Value. That the Republican party once stood for. As far as I'm concerned, the absolute failure of the Republican Party can be laid squarely on the backs of those "moderates" who are right now decrying Rush Limbaugh and his influence on the conservative base.

And to tell you the truth, I had high hopes for Michael Steele. I wanted to see a revitalized Republican Party. I wanted to see someone on the national stage finally stand up and defend conservatives from the smears and attacks of the Left. But when the head of the RNC agrees with a washed-up Leftist comedian that CPAC looked like Nazi Germany...

Nope. Sorry, but that is an EPIC FAIL. Fuck you, Steele. Fuck you, washed-up Leftoid CNN airhead. Fuck you both straight to hell.

It's obvious to me that the Republican Party no longer deserves to be in existance. Actually, that was obvious to me years ago, and it's been obvious to quite a few other people, based on how many voters are fleeing the Republican Party. And I expect that this is going to drive other people out. Great job there!

Look, I don't even listen to Rush Limbaugh. There isn't a channel out here that carries him, or Sean Hannity, or any conservative radio host for that matter. But I know that he speaks for a large chunk of conservatives. He's done more to HELP the Republican party than any other particular member of the GOP. And to attack him for a speech that was positive and uplifting? Stupid. Idiotic. And unfortunately, it's par for the course from the Republican Party elite. They've done more to hurt themselves than the Democrat American Communist Party has. Most of the wounds the GOP has taken have been self inflicted.

This was just another example of the Republican self-mutilation.

Via The Smallest Minority, I found this post at Mostly Cajun, which details the problems hitting the natural gas industry thanks to the insane regulations put in place by the EPA.

One of the things I learned was that when these engines were designed, the EPA was some sort of bad dream only found in the diseased minds of abusers of heavy drugs. That was then. This is now. Students of engine operations know there is a certain proportion of fuel to air that produces maximum power. We can’t run many of our engines there. Why? Because we’re not interested in maximum power any more. We’re interested in minimum pollution, and that ‘maximum power’ thing give a higher level of oxides of nitrogen.

That’s okay, though. We learned how to operate there, and we tested our engines regularly to see that they met the goal, and if one was acting up and emissions went up, we dutifully took it off line and fixed it. Life loped along. So they changed the rules. Where we could hit a “twenty” on the spotted owl-killing scale, they dropped the number to five. Okay, you guys on the pipeline, tighten up your acts. So the engineers twiddled and tightened things even more. And goals were met. But the baby seals were still crying from their big, soulful eyes, so the number was changed again.

You know, it’s getting VERY hard to meet the numbers. And our people tell the rulemakers. And the rulemakers say “Meet the numbers or face fines.” And our people say, “We can’t meet these numbers. We’ll have to shut down horsepower.” And the rulemakers say “Meet the numbers.” And that’s where we’re heading.

The policy-makers apparently think that we’ll keep lights on and homes heated by means of windmills and unicorn farts. I’m telling you that we folk who work in a real world have real and immutable laws to work with, things like Ohm’s Law and Boyles’ Law, and these laws and others like them say that you can’t move gas from the well to the end user without horsepower. ”’there are other laws too, and those laws, despite the attitude of the current administration, say that when it gets to the point that it costs more to do a thing, then you stop doing it, and that’s where a lot of industries, mine included, are headed.

I heat my home with Natural Gas. I'm thinking about putting in a wood stove down in the basement as a secondary furnace. And Mostly Cajun is going on the blogroll.

Further, if a candidate's performance in tracking polls had been declining steadily for three months, surely it would be time to change strategy or drop out of the race. A 30% decline is a heck of a fit, and Wall Street hasn't had anything that can be called a start since before Obama's election.

RIPON, Wis. (AP) - A state agency has approved a wastewater discharge permit allowing a dairy in the Fond du Lac County town of Rosendale to expand from fewer than 700 cows to 4,000.

The Rosendale Dairy's project was approved Monday by the Department of Natural Resources.

The 4,000 cows are expected to produce about 46 million gallons of liquid manure a year. Plans call for storing it in large reservoirs and applying it on more than 5,600 acres of cropland.

The farm's owner has said it will meet anti-pollution requirements and give the area an economic boost. But opponents have expressed concern about possible harm to ground water, odor problems and traffic congestion.

I have a plan!!

I had not realized that the courts had not even entertained seeing most of the motions to prove Obama's citizenship status. It is good to see Conservatives finally finding their voices, but it is not enough. Unfortunately I do not think the courts realize that if they do not start entertaining these motions that worse is yet to come. I have frequently heard it said that laws replace violence. When laws are no longer supported or followed violence will ensue. Unfortunately I have to agree. For once I find myself channeling what I would normally consider paranoid tendencies. With the current climate I do not think we have any choice but to plan for the worst. I can only pray for the salvation of our country so much. Though I am eternally grateful we are not near a major city.

There have been a lot of discussions concerning this. I think things that need to be entertained are as follows:

1. A full fledged suit for not just the birth records but *all* of Obama's sealed records.
This must include politicians and have backing from our Congress Critters and many other lower level politicians. This will give it more merit.
The reason that we must have such a large suit, encompassing so many documents is the cover-up factor. After having personally experienced people like him I fully understand the reality. Since he already trumped up the Hawaii "certificate of live birth", which just says he was in Hawaii and alive. If he is ever forced to cough up a birth certificate the following things will most likely be true:
1. The doctor will either be dead or willing to lie
2. The hospital records will have been destroyed, likely in a fire or a similar catastrophe
3. Documents to a high degree will have been altered
4. People will be willing to lie and cover it up because they know they will never get in trouble for it.

I truly believe that the only way to force this issue is for there to be a full fledged suite from the Republican/Conservative Party for *ALL* OF HIS *SEALED* RECORDS!!!

A birth certificate can easily be done by the likes of people who want him in the Oval Office. The chance of *all* of his records being forged would require massive cooperation from too many places, including foreign countries like Indonesia.
2. We need to enact term limits for all politicians, especially Congress & Senate!
They have been allowed to become too powerful, thus too corrupt! This needs to be put to an end NOW!!!

3. I think we are at the point were civil obedience is no longer working. Which makes Civil Disobedience the *only* answer. The protests must get bigger, and more organized. The "tea-parties" are/were a great start. The biggest downfall is that they were on a weekday. We need weekend long rallies in full sight when the majority of working people are able to be there, instead of having to take off from work. Responsible people that we are often times have difficulty taking off from work.

4. We need to actively sue President Obama and all the Congress Critters that voted for the stimulus package for the cost of it and all the pork involved.
I have not fully figured out the details on this one, but, if we can start giving them an accountability...

By all means we all have brains and I would encourage you to take what you agree with and challenge and think about parts that you disagree with. Please challenge me on this, especially if you disagree. I should hope that this gives you ideas of things to do and discuss with your local groups.




Internet reports mock 'Birthers' who want constitutional proof

Basically this article calls those of us who indeed want to know if Obama is eligible to hold the office of President of the United States of America are
"conspiracy theorists, including the following: embarrassing, destructive, crazy, nutburger, demagogue, money-hungry, exploitative, irresponsible, filthy conservative imposters, the worst enemy of the conservative movement, weird, demented, sick, troubled and not suitable for civilized company."

Politico's coverage of the questions that still linger over Obama's birth, however, is far from kind.

"Viewed as irrelevant by the White House, and as embarrassing by much of the Republican Party," writes Politico blogger Ben Smith, "the subculture still thrives from the conservative website WorldNetDaily, which claims that some 300,000 people have signed a petition demanding more information on Obama's birth."

Smith then states unequivocally that there is no basis for questioning Obama's eligibility, that Obama "was in fact born in Honolulu in 1961" and that "long-settled law" resolves his dual citizenship at birth, another fount of legal questions surrounding the sitting president's eligibility to serve in the Oval Office. Smith cites Hawaii officials who have testified that there do exist records – though unreleased to the public or the courts – verifying Obama's American birth.



s part of the case, a subpoena was served on Occidental College for its records. School officials immediately contacted lawyers for Obama and said the demand would have to be answered unless they intervened.

Obama's lawyers then submitted a demand to the court arguing the case was moot because the election was over and the correct place to resolve such concerns was in Congress. The lawyers also alleged a variety of procedural errors.

In his response, Kreep pointed out that Obama's lawyers failed for 27 days to notify the USJF of alleged procedural errors. He said the housing and academic records are of prime importance.

"From those records, statements as to whether MR. OBAMA is, indeed, a 'natural born citizen' may be found," he said.

At the end of February, at least two active-duty soldiers serving in Iraq as well as a retired major general offered to be plaintiffs in a lawsuit challenging Obama's eligibility.

WND reported earlier when 1st Lt. Scott Easterling confirmed to Orly Taitz that he wanted to be a plaintiff in the legal action she is preparing on behalf of members of the U.S. military, both active and retired. A second soldier who asked that his name be withheld for now became part of the action a day later.

Then retired Maj. Gen. Carroll D. Childers submitted a statement to Taitz and her DefendOurFreedoms.us website, agreeing to be a plaintiff in her pending action.

Taitz explained the issue isn't resolved as many Obama supporters claim.

The "Certification of Live Birth" posted on the Internet actually doesn't confirm a birth location, she said.

"[Hawaii] statute 138 allows foreign born children of HI residents to get HI [Certificates of Live Birth] and get them based on a statement of one relative only," she said.

She also said Hawaiian officials, while they confirmed a birth certificate exists, did not exclude the possibility it was "one obtained for a foreign born child."

She also cited Obama's immigration to Indonesia at age 5, when he was considered an Indonesian citizen.

Although Obama officials have told WND all such allegations are "garbage," here is a partial listing and status update for some of the cases over Obama's eligibility:

  • New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn't properly ascertain that Obama is qualified to hold the office of president.

  • Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama which is under seal at the U.S. District Court level and Hollister vs. Soetoro a/k/a Obama, brought on behalf of a retired military member who could be facing recall to active duty by Obama.

  • Leo Donofrio of New Jersey filed a lawsuit claiming Obama's dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.

  • Cort Wrotnowski filed suit against Connecticut's secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.

  • Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public's support.

  • Chicago attorney Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama's vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.

  • Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama's eligibility could be confirmed, alleging doubt about Obama's citizenship. His case was denied.

  • In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.

  • In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama's citizenship. The case was denied.

  • In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama's birth certificate. His request for an injunction against Georgia's secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.

  • California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.

In addition, other cases cited on the RightSideofLife blog as raising questions about Obama's eligibility include:

  • In Texas, Darrel Hunter vs. Obama later was dismissed.

  • In Ohio, Gordon Stamper vs. U.S. later was dismissed.

  • In Texas, Brockhausen vs. Andrade.

  • In Washington, L. Charles Cohen vs. Obama.

  • In Hawaii, Keyes vs. Lingle, dismissed.

WND senior reporter Jerome Corsi had gone to both Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions, the biggest being why, if there exists documentation of Obama's eligibility, hasn't it been released to quell the rumors.

Instead, a series of law firms have been hired on Obama's behalf around the nation to prevent any public access to his birth certificate, passport records, college records and other documents.

Mass. healthcare reform is failing us


MASSACHUSETTS HAS been lauded for its healthcare reform, but the program is a failure. Created solely to achieve universal insurance coverage, the plan does not even begin to address the other essential components of a successful healthcare system.


What would such a system provide? The prestigious Institute of Medicine, part of the National Academy of Sciences, has defined five criteria for healthcare reform. Coverage should be: universal, not tied to a job, affordable for individuals and families, affordable for society, and it should provide access to high-quality care for everyone.

The state's plan flunks on all counts.

First, it has not achieved universal healthcare, although the reform has been a boon to the private insurance industry. The state has more than 200,000 without coverage, and the count can only go up with rising unemployment.


The article covers many instances where people had to give up treatment due to lack of affordability and then goes on to tout that we need to go off of the Medicaid model and improve and expand it. I call B.S. If we do what is suggested in this article all of the good medical practitioners will be gone. They will not be able to afford to keep their doors open, and what they are allowed to do by Medicaid rules is so limiting that it is not health care. The rules basically have a criteria that requires you to follow it and if your patient is outside the norms no additional tests can be run because there is nothing to qualify them. It is very inhuman. It is like asking an accountant to run the purchases for a kitchen. They will buy the cheapest items available, but they most likely will not do the job well or for long.

Obama's Next Big Battle: Affordable Health Care



Obama is asking for $634 billion in his new budget to be put aside over the next 10 years as a sort of health care fund. He says some of the money will come from taxing the wealthy and through trimming the fat in current government programs like Medicare and Medicaid.

The budget calls for also taking, over 10 years, $175 billion in fees that the government now pays insurance companies to cover more than 10 million people in private Medicare. The administration has said that that such private plans cost 14 percent more than traditional Medicare.

In his weekly video address Saturday, Obama acknowledged that "the insurance industry won't like the idea that they'll have to bid competitively to continue offering Medicare coverage, but that's how we'll help preserve and protect Medicare and lower health care costs for American families."

Others that might suffer under his budget include hospitals, drug makers and home health services. All have powerful lobbying groups.

The ambitious plan comes during the worst economic crisis this country has seen in a generation. Health care reform wasn't achievable in even the best of times. Now, it could be that much harder.



What is not being said is that Medicare and Medicaid are hardly accepted because they do not even cover the providers costs. He talks about hospitals, drug makers and home health having powerful lobbying groups, the reality is that hospitals have to treat whom ever comes into the Emergency Room, Drug companies spend millions trying to formulate new drugs, many of which never make it through the trials, and home health is a lot cheaper than nursing homes. People who have no health insurance can go to county or urgency care clinics and emergency rooms if they need. They will not be turned away for inability to pay. There is no reality hear. We will see socialized health care that no one wants.

SHARM EL-SHEIKH, Egypt, March 1 -- The United States on Monday will pledge $300 million in humanitarian relief for people in Gaza after the 22-day war with Israel but will maintain restrictions to prevent any assistance from reaching Hamas, State Department spokesman Robert A. Wood said.

Secretary of State Hillary Rodham Clinton, attending an international conference here to raise funds for the Gaza Strip, will also announce $600 million in assistance to the Palestinian Authority, which is controlled by Fatah, a rival of Hamas that is dominant in the West Bank.



Unfortunately this money will only be used to wipe the Jewish state of Israel off the face of the planet!!!

Congress's coal-fired power plant

Bill McKibben is also an activist and he is headed to Washington to take part in Monday's protest at the coal-fired power plant that supplies heat and A/C to the U.S. Capitol. Yesterday, in anticipation of the protest, House Speaker Nancy Pelosi again called for its full conversion to natural gas. Meanwhile, NASA's top climate scientist, James Hansen, said he supported the act of civil disobedience, providing FOX News with a controversy to report. (Make sure you read the quote about God and global warming by the Republican congressman from California, Rohrabacher.) . . . Could someone--preferably Pelosi and Reid, who apparently think they know better than we do--explain to us stupid common little people how and why changing that plant from one fossil fuel to another is supposed to be a "green" improvement? If it burns natural gas, it still emits "greenhouse gases" in the form of CO2 and other emissions. Why not go instead with a small self-contained nuclear reactor, or better yet windmills or heat turbines feeding off the hot air emanating nearby?

Uncertainty over new health safety net for jobless


WASHINGTON – The Obama administration rushed to include a health care safety net for laid-off workers in the recently signed stimulus bill, but has not told employers exactly how to make it work.

As a result, tens of thousands of jobless people could wait months before getting help paying for health insurance that their employers previously had covered.

The one that goes "Why don't conservatives ever get together and hold a protest? It's because conservatives have jobs."

I don't know how funny that joke is, but it's true. It's also true that conservatives, by and large, don't feel like going out and waving a sign all day. So historically the Right has never done the protests, the chants, etc etc etc.

Now I've heard some folks on the right sneering at the low turnout at various Tea Parties, and saying how this doesn't mean anything.

200 on a workday is low turnout? There was a group of us who wanted to hold one here, but we all had to work. Getting 200 people to take the day off and actually hold this thing is impressive! But what really torques me off is how dismissive I've seen people on the Right be about these "Tea Parties". Hey, assholes: Could you step down off of your high horse long enough to at least show a little support? You don't have to say much of anything, hell, at this point not STABBING FELLOW CONSERVATIVES IN THE BACK would be a good start.

Bah. And every shop I went to yesterday was out of 7.62X54R ammo. Not a single cartridge to be found. I'm getting ticked off. I'll be buying the corrosive stuff online before too long, if they're not out of THAT at cheaperthandirt.com.
